Appeals Process Review and documentation
In an effort to follow our guiding principles, better serve the community, and with input from the POA Appeals Committees, your Board of Directors is in the course of evaluating the appeals process. The appeals process is mandated by the state and has been in place for many years. It exists to provide a path for each member to follow when they find themselves in a dispute with the POA over a violation, a citation, or any other matter. As part of this evaluation they are looking to identify the many different sources of appeals. Rules violations, citations, property damage, delinquent assessments and property damage are a few of the different sources for appeals. Each source may have a different path for appeal with varying levels to appeal to. A simple rules violation might have three levels of appeal while a more serious matter might have more levels or methods of appeal. If appeal. Each level of appeal allows the member to restate their case with additional information, if there is any that pertains to the appeal.
The review of our existing procedures has led us to find the system has been operating properly and fairly in the past but, to our understanding, has not ever been recorded or documented as a standard procedure.
To stay with our core values to continuously improve or community the Board of Directors will be evaluating the appeals process at the December 1st open board meeting in an effort to streamline, document and adopt a fair policy that is understood and will be in place for future boards.
